REGULAR MEETING
For the
City Council of Lookout Mountain, Georgia
November 15, 2007
PRESIDING: Thomas G. Gifford, Mayor
PRESENT: Council Members Dennis Eischeid, Catherine Kelley, Sandy Gothard, Daniel Pettway, Ray Seipp, City Clerk Dana Driver, City Attorney Bill Pickering, and Chief Wallace Taylor.
CALL TO ORDER: Mayor Gifford called the meeting of the City Council to order at 5:30 p.m. at City Hall, 1214 Lula Lake Road, Lookout Mountain, Georgia.
APPROVAL OF MINUTES: The minutes of the regular meeting held on October 18, 2007 were approved as submitted.
PRIVILEGE LICENSE REQUEST – Mr. Eddie Francisco submitted his application for a portable restaurant called “Git Er Here Café”. Mr. Francisco assured the council water and sewer would be hooked up to the drains and the pumping out the sewer tanks would be at Mr. Francisco’s expense. The portable restaurant would sit on the site of the former Mountain Market, zoned commercial, and would be in operation until Scott Maclellan would rebuild on the site. The restaurant is a permitted use with the commercial zone. Portable buildings are not allowed within the city limits but since the restaurant would be temporary, the license was granted subject to the Planning Commission approval of the building.
PRIVILEGE LICENSE REQUEST – Jenks Parker, along with his son, Simon Parker, presented a request for a privilege license to operate a curbside recycling service that has not been formally named yet. This service would pick up recyclables including paper, plastic, glass, and aluminum cans each week for a weekly fee of $5 or a monthly fee of a $20. The Parkers would provide one bin with a lid to each customer. Mr. Parker would like to expand his business at some point to recycling old electronics. Mr. Parker was asked provide a report to the council as to how much recycling is being picked up each month. Motion was granted to approve the license as requested and the Mayor thanked the Parkers for providing their service to the City.
STORMWATER REPORT – Mr. Brad Haven, Stormwater and Sewer Superintendent, presented to the Mayor and the Council proposed stormwater projects as outlined in our NOI in preparation of our NPDES Annual Report due in Dec. Options were discussed for improving the fueling station and the salt storage bin areas per suggestions from Catherine Fox, our stormwater consultant.
PEDESTRIAN PATHWAY NEWS – Councilman Pettway informed the council that the City signed the contract with Kleenco Construction on Nov. 9. Kleenco has established a fenced in staging area for their equipment behind Fairyland School. Kleenco has 90 days from the signing of the contract to complete the project, which should end the 1st week of February.
The billing process was outlined as follows: invoices will be submitted for approval to Barge Waggoner; Barge will submit invoice to the City for payment; the City has 5 days to turn into GDOT for reimbursement and GDOT should reimburse the City by end of the month.
Kleenco was granted permission to work on Saturday provided they were mindful of the time sensitivity early in the morning and after sundown.
Ads for bids on lampposts were placed in the Walker County Messenger, and letters were sent to 4 suppliers requesting bids. These bids will be in by December 6 and Councilman Pettway should have a recommendation to the Council by next month’s meeting.
The Mayor again thanked and praised Councilman Pettway for his diligent work getting the Pathway construction underway.
GOLF CART/MOTORIZED VEHICLE ORDINANCE – Attorney Pickering presented to the Council an amended draft of the golf cart ordinance which read that golf carts would be permissible provided they do not cross state or county roads and the golf carts must abide by all traffic laws with regulatory requirements. After discussion by the Mayor and the Council, no motion was forthcoming. The Mayor directed the Chief and the Vice Mayor to notify the golf cart owners that the City Council has chosen not to take action, and, therefore, existing State law applies. State law prohibits any motorized vehicle of less than 1,300 lbs and going less than 20 m.p.h to cross any intersection within the City that is a state or county road such as Lula Lake Road and Red Riding Hood Trail.
MAYOR’S REPORT
1) Clerk Dana Driver has been working on sending out current tax bills, and he commended her efforts in collecting delinquent taxes for the City.
2) The Mayor spoke with Representative Martin Scott regarding the status of the Georgia speaker of the House’s bill Great Plan. Representative Scott told the Mayor that he has not taken a position on the bill yet because the bill has not been finalized yet.
3) The leaf machine has been re-built and is already in operation. The salt machine is ready to go and salt is on hand in case of inclement weather.
4) Chief Taylor informed the Mayor and the Council that the 3rd Annual Festival of Lights will take place Saturday, December 22, 2007 at 6:30 p.m. Kits can be ordered from City Hall and will be delivered after Monday, December 10.
